Pursuant to section 39A of the Resource Management
Act 1991, the Minister for the Environment gives the following notice.
N o t i c e
1. I approve the following as qualifications establishing a person's accreditation under section 39A of the Resource Management Act 1991:
(a) Successful completion of the "Making Good Decisions" foundation course, as evidenced by
a certificate issued any date on or after 25 July
2010, that has not expired under clause 4. "Making Good Decisions" is a programme developed by
the Ministry for the Environment as a qualification for accreditation under section 39A of the Resource Management Act 1991;
(b) successful completion of a "Making Good Decisions" recertification course, by a person
whose accreditation expires under clauses 4 or
5, as evidenced by a certificate issued any date on
or after 25 July 2008, that has not expired under clause 5;
(c) appointment under section 4 of the Judicature Act 1908 as a Judge of the High Court, under section
11 as a temporary Judge or under section 11A
as an acting Judge. An appointment under section
4 continues to qualify the person on and after his
or her cessation of service as a Judge of the High Court, temporary Judge or acting Judge;
(d) appointment under section 250 of the Resource Management Act 1991 as an Environment Judge or an alternate Environment Judge. An appointment under section 250 continues to qualify the person
on and after his or her cessation of service as an Environment Judge or alternate Environment Judge; and
(e) appointment under section 254 of the Resource Management Act 1991 and five years or more service as an Environment Commissioner or
Deputy Environment Commissioner. A person's qualification under this clause expires after a
period of three years from the date of that person's cessation of service as an Environment Commissioner or Deputy Environment Commissioner. Such a person continues to be accredited if that person is qualified under clause 1(b) prior to the expiry of their accreditation.
2. For the purposes of clause 1(a) of this notice, "successful completion" means:
(a) the receipt of a certificate following attendance at a certification course on the Making Good Decisions programme and gaining a total mark of 50% or more across the assignment components; or
(b) in respect of the "Making Good Decisions" programme for presenters and facilitators, the
receipt of a certificate following a demonstration
of a sound understanding of the "Making Good Decisions" certification course goals and content
to a panel of experts appointed by the Ministry for the Environment.
3. For the purposes of clause 1(b), "successful completion" means:
(a) the receipt of a certificate following attendance
at a recertification course on the Making Good Decisions programme and gaining a total mark of 50% or more across the assignment components; or
(b) in respect of the "Making Good Decisions" programme for presenters and facilitators, the receipt of a certificate following a demonstration
of a sound understanding of the "Making Good Decisions" recertification course goals and content to a panel of experts appointed by the Ministry for the Environment.
4. A person's qualification under clause 1(a) expires after a period of three years from the date of issue evidenced on that person's certificate.
5. A person's qualification under clause 1(b) expires after a period of five years from the date of issue evidenced on that person's certificate.
6. A person whose qualification expires under clauses 4 or 5 continues to be accredited if the person completes a qualification under clause 1(b) prior to the expiry date on the expiring certificate.
7. Qualifications under clauses 1(a) or 1(b) that would ordinarily expire prior to 1 January 2014 by the operation of clauses 4 or 5 will expire on 30 June 2014.
8. This notice amends and replaces the "Notice of Accreditation under the Resource Management Act 1991", published in the New Zealand Gazette,
29 June 2006, No. 73, page 1866, in its entirety with effect from the date of publication of this notice.
