Pursuant to section 65ZD(3) of the Public Finance Act 1989, the Minister of Finance makes the following statement:
"On 3 April 2013, I, The Honourable Simon William English, Minister of Finance, on behalf of the Crown, gave the following indemnities in relation to the initial public offering of up to 49% of the shares in Mighty River Power Limited (the "MRP IPO"):
a an indemnity to First NZ Capital Securities Limited and Credit Suisse (Australia) Limited, Goldman Sachs New Zealand Limited and Macquarie Securities (NZ) Limited in the Offer Management Agreement dated
3 April 2013 for certain liabilities, costs and expenses they incur in performing their role as joint lead managers under that Agreement
b an indemnity to Mighty River Power Limited in respect of certain liabilities, costs and expenses which it may incur as a result of any claim or proceedings brought or threatened against it in respect of the MRP IPO, and
c an indemnity to each director on the Board of Mighty River Power Ltd in respect of certain liabilities, costs and expenses which the director may incur as a result of any claim or proceedings brought or threatened against it in respect of the MRP IPO."
