Notice of Application for Approval of a Scheme
Under the Charitable Trusts Act 1957
Take notice that on 5 December 2012, on the application
of PRESBYTERIAN SUPPORT EAST COAST, the
High Court of New Zealand at Napier in proceeding
CIV-2012-441-625 made the following orders approving a scheme under Part 3 of the Charitable Trusts Act 1957:
1. Under the Charitable Trusts Act 1957, the Court approves a scheme that the bequest by Edward Durning Holt (made in clause 2(iii) of the codicil dated
29 November 1976 to his will dated 12 September 1975, as amended by order of the High Court on or about
20 September 2001) to Presbyterian Support Services - East Coast for the general purposes of its Atawhai Homes at Taradale, shall be used by PRESBYTERIAN SUPPORT EAST COAST for the general purposes of its JH Mason Retirement Village at 87 Te Mata Road, Havelock North.
2. The sum of $750.00 shall be paid from the bequest to
the Attorney-General in respect of the report of the Attorney-General.
3. The applicant’s costs and disbursements of the proceeding fixed in the sum of $9,549.93 shall be paid from the bequest.
