Notice of Receipt of Pricing Review Applications for the UCLL Standard Terms Determination

The Commerce Commission ("Commission") gives notice that it has received applications for a review of the price set for the regulated service Chorus’ unbundled copper local loop network.
The price for this service is regulated in the Commission’s Standard terms determination for the designated service Chorus’s unbundled copper local loop network, Commerce Commission Decision 609, 7 December 2007 ("the UCLL STD").
This notice is made under section 43 of the Telecommunications Act 2001 ("Act").
On 3 December 2012, the Commission released its Final decision on the benchmarking review for the unbundled copper local loop service ([2012] NZCC 37).
In that decision, the Commission determined the regulated prices for the UCLL service using international benchmarks, as required by the Act.
The Commission determined a geographically averaged UCLL monthly rental price of $23.52, coming into effect on 1 December 2014.
The Commission also set urban and non-urban UCLL monthly rental prices of $19.08 and $35.20 respectively, coming into effect immediately.
New UCLL connection charges were also determined.
The determined price of the UCLL service also applies to the price for the regulated service Chorus’ unbundled copper low frequency service, and is used to derive the prices for the sub-loop services set under the Standard terms determination for Chorus’ sub-loop unbundled copper local loop services, Commerce Commission Decision 672,
(18 June 2009).
The price of the UCLL service is also a component of the price for the regulated service Chorus’ unbundled bitstream access (UBA).

The Commission has received four applications for a pricing review for the above-mentioned determination from parties under section 42 of the Act.
The parties that have submitted an application are Chorus New Zealand Limited, Kordia Limited, Callplus Limited and Vodafone New Zealand Limited.
The Commission has also received an application from Telecom New Zealand Limited.
However, as Telecom is not currently a party to the UCLL STD, the Commission’s initial view is that this application cannot be accepted.
Parties are required to comment on the matter by written notice to the Commission no later than 10 working days after receipt of this notification.
