Electricity Industry (Exemption No. 185 (Contact Energy Limited)) Exemption Notice 2013

Pursuant to section 11 of the Electricity Industry Act 2010 ("Act") and section 13 of the Interpretation Act 1999, the Electricity Authority gives the following notice.
N o t i c e
1. Title and commencement-(1) This notice is the Electricity Industry (Exemption No. 185 (Contact Energy Limited)) Exemption Notice 2013.
(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.
2. Exemption-Contact Energy Limited ("Contact") is exempted from compliance with clause 11 of Schedule
15.3 of the Electricity Industry Participation Code 2010 ("Code") in respect of the following installation control points ("ICPs"):
ICP identifier ICP identifier
1 0000038627NTADB 7 0008801012TP900
2 0000557925UND32 8 0014189134HBC96
3 0000600085HBD8B 9 0016096032EL6DD
4 0000916610TEA3F 10 0018137292HB7F1
5 0001183605HB0B0 11 0046054751HBFE7
6 0005000772HBA61
3. Term-This exemption expires on the date on which Contact no longer has the responsibility in the registry as the trader for the ICPs listed above.
4. Reasons for granting the exemption-The reasons for granting this exemption are:
(a) Contact would incur significant compliance costs in setting up the distributed unmetered load ("DUML") databases for these low consumption ICPs;
(b) the cost of maintaining the databases and undertaking annual audits of them would be disproportionate to the size of the load;
(c) the load at these ICPs is static, will have little annual variation, and changes can be accurately tracked;
(d) Contact has stated it will continue to treat the loads as standard unmetered loads and record the information in the registry;
(e) creating new ICP identifiers for each of the points
of connection at each of the 11 ICPs would avoid
the need to establish a DUML database at each
ICP because each ICP could then be treated as a standard unmetered load rather than aggregated as
a distributed unmetered load. However, this would impose additional fixed charges on consumers for no extra benefit;
(f) the exemption will have little or no impact on other participants and service providers, and will not affect any other Code provisions; and
(g) granting the exemption meets the requirements of section 11(2) of the Act.
Dated at Wellington this 21st day of October 2013.
For and on behalf of the Electricity Authority:
DR THOMAS BRENT LAYTON, Chairperson, Electricity Authority.
