The Commerce Commission ("Commission") is advising all telecommunications service providers that they will need to check whether they are required to provide information under section 82 of the Telecommunications Act 2001
("the Act") to support identifying liable persons who
will pay a portion of the 2012/13 Telecommunications Development Levy.
Liable persons obliged to provide information under section 82 would have earned $10 million or more from providing telecommunications services (such as voice, data or other services excluding broadcasting) by means of a component of a public telecommunications network in the 2011/12 financial year.
Importantly, the $10 million threshold can be met through revenue from a combination of liable persons where there is significant shareholding between two or more parties.

The Commission gives public notice that the closing date
for information disclosure under section 82 of the Act is
4 April 2013.
