Final Notice to Creditors to Prove Debts or Claims
Notice is hereby given that, in accordance with section 241(2)(a) of the Companies Act 1993, the shareholders of the above-named company, on 30 September 2010 at 10.30am, appointed Peri Micaela Finnigan and Boris van Delden, insolvency practitioners of Auckland, jointly and severally as liquidators of the company.
The liquidators hereby fix 6 July 2012 as the day on or before which the creditors of the company are to prove their debts or claims and to establish any priority their claims may have under section 312 of the Companies Act 1993.
If a creditor does not make a claim on or before 6 July 2012, the liquidators may exclude that creditor from the benefit
of any distribution made to the company's creditors or to other entitled persons.
The liquidators have sought directions from the High Court on how the distribution to creditors is to be made.
Any creditor who has lodged a proof of debt with the liquidators can request a copy of that application from
the liquidators.
The liquidators' application for directions is next before the High Court at Auckland on 27 July 2012 at 11.45am.
The High Court has directed that any parties wishing to oppose the liquidators' application or wishing to be heard should file and serve their notice of opposition or appearance by that time.
