The applicant claims the right to convey water is redundant by reason of the circumstances set out below.

Circumstances: Parts of the dominant land have become physically separated from the servient land as a result of subdivision shown on plans DP 66260, DP 325406, DP 334197, DP 46240 and DP 62691.
