Land Transfer Act Notice

An application, under section 70 of the Land Transfer Act 1952, has been received for the removal of an easement.
The applicant claims the easement is redundant by reason of the circumstances set out below.
If no objections have been received before 13 December 2012, the Register will be updated to record the easement as redundant.

Easement: Effluent reticulation and disposal easement over Lot 30 DP 210593; marked "M" on DP 210593 comprised in Computer Freehold Register NA138D/724 (servient tenement) in favour of Lots 1-29 and 31-34 DP 210593 comprised
in Computer Freehold Registers NA138D/695-723 and NA138D/725-728, Lots 35-42 DP 327767 comprised in Computer Freehold Registers 112875-112882, Lots 43-110 DP 328948 comprised in Computer Freehold Registers 118109-118176, Lots 111-120 DP 210594 comprised in Computer Freehold Registers NA138D/730-739, and Lots 120-147 and Lot 149 DP 366291 comprised in Computer Freehold Registers 268663-268691 (dominant tenements) specified in easement certificate D672257.6 and registered on 15 January 2002.
Circumstances: Easement Certificate D672257.6, clause 2, provides for determination of the easement upon a community sewage scheme being made available to the dominant lots, as the easement no longer serves the dominant land and is no longer in force, used or operative and such lots are being connected to the Kaipara District Council’s effluent reticulation and sewage treatment scheme.
