Land Transfer Act Notice

The applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the removal of a right (if any) to divert and convey water.
The applicant claims the right to divert and convey water is redundant by reason of the circumstances set out below.
I intend to remove the right to convey water on 11 June 2012 if no objections have been received before that date.
Application: 9041668.1.
Applicant: Aurora Energy Limited, 10 Halsey Street, Dunedin.
Easement: Right (if any) to divert and convey water for the purpose of a flour mill from the Kaikorai Stream in Section 69 Lower Kaikorai Survey District and convey it by race leading from that Section and by fluming or pipes (as shown on DP 1730)
as appurtenant to the flour mill on part Section 64 Lower Kaikorai Survey District comprised in Computer Freehold Register 5454.
Circumstances: The dominant land has become physically separated from the servient land as a result of subdivision and the easement no longer serves the dominant tenement. It appears also that the servient land comprised in Computer Freehold Register OT186/256 was never part of Section 69 Lower Kaikorai Survey District.
