Notice of Intention to Take Land for Roading, Stormwater Management and Walkway Purposes, and Lease for Temporary Occupation-128 Ormiston Road, Flat Bush, Manukau City

Notice is hereby given that the Auckland Council, under the provisions of section 23 of the Public Works Act 1981, proposes to take the land firstly described in the Schedule to this notice and take a leasehold interest in the Lease Area secondly described in the Schedule to this notice for road construction works.
The Land and Lease Area are required as part of a project for development of the Flat Bush area.
More particularly:
(a) The Land will be used for the widening of the
road to provide two traffic lanes, a cycle lane
and berm, and will complete the final link of road widening in the project. The stormwater area will provide for improved stormwater management and, together with the accessway, will form an extension of adjoining public open space land.
(b) The Lease Area will be occupied by the Auckland Council during construction of the road and all reinstatement works and will provide for safety and security of construction workers, machinery and equipment, and for public safety.
The project, incorporating the widening of Ormiston Road, Te Irirangi Drive and Chapel Road and construction of a bridge on Chapel Road, is being undertaken as part of the development of the Flat Bush area.
The road works will improve overall traffic management and safety within the area and the acquisition of the stormwater area is required for stream alignment works and will enable construction of the Chapel Road Bridge to proceed.
The stormwater area and the accessway link with adjoining public open space land enable the Auckland Council to create greater certainty in protecting and enhancing the area long term.
The owners of the Land and Lease Area and those persons with a registered interest in them have been served with notice of the Auckland Council's intention to take the Land and Lease Area and have been advised of their right to object.
Any other person having the right to object may send a written objection to the Registrar, Environment Court, Tribunals Division, Department for Courts, PO Box 5027, Lambton Quay, Wellington 6145, within 20 working days after date of the publication of this notice.
If any objection is made in accordance with this notice, a public hearing will be held with the right of the objector to appear and be heard personally unless the objector otherwise requires, and each objector will be informed of the time and place of the hearing.

124 Parish of Pakuranga contained in Computer Freehold Register NA766/12 being:
Firstly:
795 square metres, more or less (subject to survey), being Section 2 on SO 446394 (for the purpose of reserve, walkway);
2.1861 hectares, more or less (subject to survey), being Section 3 on SO 446394 (for the purpose of reserve, stormwater management), and
3298 square metres, more or less (subject to survey), being Section 5 on SO 446394 (for the purpose of road) ("Land"); and
Secondly:
4023 square metres, more or less (subject to survey), being Section 4 on SO 446394 for temporary occupation lease for road construction works
("Lease Area") for a period of approximately
30 months from occupation at a rental of $4,000.00 plus GST (if any) per calendar month, subject to the Auckland Council having a right to terminate the lease earlier by written notice to the owners, such lease to be for the benefit of and enforceable by Auckland Transport for the purposes of the Contracts (Privity) Act 1982.
