Notice of Intention to Redefine the West Coast North Island Marine Mammal Sanctuary

Pursuant to section 22(1) of the Marine Mammals Protection Act 1978, I give notice that I intend, with the consent of the Minister for Primary Industries, the Minister of Transport, and the Minister of Energy and Resources:
(a) to redefine the West Coast North Island Marine Mammal Sanctuary declared by the Marine Mammals Protection (West Coast North Island Sanctuary) Notice 20081 (the principal notice) so that it includes all the area of the sea enclosed by a line:
(i) commencing at mean high-water springs
at a point on Oakura Beach, Taranaki (approximately 39?07.08´S and 173?55.87´E); and
(ii) proceeding generally southward along the line
of mean high-water springs to a point near
Hawera, Taranaki (approximately 39?37.12´S and 174?16.50´E); and
(iii) proceeding along a bearing of 180? to the point where it intersects with the outer limit of the territorial sea; and
(iv) proceeding generally northward along the outer limit of the territorial sea to the point
on a bearing of 270? from the point of commencement; and
(v) proceeding back to the point of commencement,
including all areas of the sea contained in the internal waters between the point of commencement on Oakura Beach (approximately 39?07.08´S
and 173?55.87´E) and the point near Hawera (approximately 39?37.12´S and 174?16.50´E); and
(b) to impose on the area of the redefined sanctuary described in paragraph (a) all the restrictions set out in clause 5 of the principal notice (which relates to seismic surveying); and
(c) to exclude from the area of the redefined sanctuary described in paragraph (a) the restrictions set out in
clause 6 of the principal notice (which relates to restrictions on mining); and
(d) to amend clause 4(1) of the principal notice to exclude from the sanctuary the Tapuae Marine Reserve created by the Marine Reserve (Tapuae) Order 2008.2
A map of the sanctuary as I intend to redefine it is available for inspection on the website of the Department of Conservation at
www.doc.govt.nz
The map is indicative only, and if there is a discrepancy between the map and the verbal description in paragraph
(a) of this notice, the verbal description prevails.
I will consider any written submission on my intention to redefine the sanctuary or any of the restrictions I intend
to impose if:
(a) it is addressed to the Minister of Conservation as follows:

(b) I receive it within 28 days after the publication of this notice in the New Zealand Gazette.
