Notice is hereby given that the Auckland Council, under the provisions of section 23 of the Public Works Act 1981, proposes to take the interest in land described in the First Schedule of this notice and an easement for access and maintenance over the land described in the Second Schedule of this notice.
The land described in the First Schedule is required for a road in connection with the Massey North Town Centre, Auckland. The easement described in the Second Schedule will be required for access and maintenance of the retaining walls that will provide support for the road.
The reason why Auckland Council considers it reasonably necessary to take the interest in the land described in the First Schedule and the easement described in the Second Schedule is that construction of the road on the land to be taken is integral to the efficient functioning of the roading network serving the land to be developed at Massey North under Plan Change 15 of the Auckland District Plan (Waitakere Section). In particular, the road will provide an important access point to the new town centre and Auckland Council’s social infrastructure to be developed within
the new town centre and a bus interchange.
The owners of the land have been served with notice of the Auckland Council’s intention to take the land and have been advised of their right to object.
Any other person having the right to object may send a written objection to the Registrar, Environment Court, Tribunals Division, Department for Courts, PO Box 5027, Wellington 6145, within 20 working days after the date of publication of this notice.
If any objection is made in accordance with this notice, a public hearing will be held with the right of the objector to appear and be heard personally unless the objector otherwise requires, and each objector will be informed of the time and place of the hearing.

Second Schedule
An easement in gross for access and maintenance over 233 square metres being Area "E" on SO 450412 and 341 square metres being Area "F" on SO 450412, being parts of Lot 2 DP 92307 (part Computer Freehold Register NA48D/927).
This land is located at 19 Fred Taylor Drive, Massey, Auckland.
