Special Needs Grants Amendment (No 2) 2012

Pursuant to section 124(1)(d) of the Social Security Act 1964, the Minister for Social Development makes the following instrument.
I n s t r u m e n t
1. Title-This instrument is the Special Needs Grants Amendment (No 2) 2012.
2. Commencement-This instrument comes into effect on the 3 December 2012.
3. Principal programme-This instrument amends the Special Needs Grant Programme (as established and approved on 18 December 1998*) (the principal programme).
4. Clause 3 amended (Definitions)-In clause 3.1, revoke the definition of Land Based Industry.
5. Clause 18 amended (Grants to Farmers, Orchardists, etc.)-(1) In clause 18.2, replace "Land Based Industry" wherever it appears with "Primary Industry".
(2) Revoke clause 18.3A.
(3) In clause 18.4, definition of Cash Assets, paragraph (d), replace "Land Based Industry" with "Primary Industry".
(4) In clause 18.5, definition of Farmer, replace "Land Based Industry" wherever it appears with "Primary Industry".
(5) In clause 18.5, replace the definition of "Land Based Industry" with "Primary Industry includes, but is
not limited to, the primary production of meat, wool, or dairy products, arable farming, aquaculture, horticulture, viticulture, forestry, sharemilking, an orchard, apiculture, herb or flower growing, a market garden, and poultry farming but does not include hobby farming".
(6) Revoke clause 18.6A.

Explanatory Note
This note is not part of the instrument but is intended to indicate its general effect.
This instrument, which comes into effect on the 3 December 2012, amends the Special Needs Grants programme by replacing the definition of land based industry with a definition of primary industry and making consequential referential changes. It also removes provision for grants of rural assistance to bee-keepers who are affected by Varroa Jacobsoni species (honey bee mite).
