Notification by the Minister of Corrections Pursuant to Section 170(1) of the Corrections Act 2004: Security Contract and Prison Management Contract

I, The Honourable Anne Merrilyn Tolley, Minister of Corrections, hereby give notice that on 10 September 2012, Her Majesty The Queen in Right of New Zealand, acting
by and through the Chief Executive of the Department
of Corrections and SecureFuture Wiri Limited ("SecureFuture"), entered into the Agreement relating to
the Public Private Partnership at Wiri Men’s Prison Project ("the Contract"), incorporating both a security contract under section 166(1) of the Corrections Act 2004 ("the Act") and a prison management contract under section 198(1) of the Act.
In summary, the Contract provides for the design, build, finance, operation and maintenance of a new men’s prison
at Wiri.
The Contract provides that SecureFuture, as the
Contractor, may subcontract both security contract and prison management services to Serco New Zealand
Limited ("Serco").
As such, Serco will provide escort services and will undertake prison management services but SecureFuture Wiri Limited, as the party to the security contract and
prison management contract, has ultimate responsibility under the Contract for the provision of the escort services and for undertaking the prison management services.
Therefore both SecureFuture and Serco are treated as a security contractor and a prison management contractor under the Contract and the Act (including regulations, instructions and guidelines made under the Act) in respect
of the subcontracted escort services and prison management services.
