Electricity Industry (Exemption No. 159 (TrustPower Limited)) Exemption Notice 2012

Pursuant to section 11 of the Electricity Industry Act 2010 ("Act"), the Electricity Authority gives the following notice.
N o t i c e
1. Title and commencement-(1) This notice is the Electricity Industry (Exemption No. 159 (TrustPower Limited)) Exemption Notice 2012.
(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.
2. Exemption-TrustPower Limited ("TrustPower") is exempted from compliance with clause 10.3(b) of the Electricity Industry Participation Code 2010 ("Code") in respect of the installation control point ("ICP") 0001131999MLC77.
3. Term-This exemption expires on the date when TrustPower ceases to be recorded in the registry as having the responsibility as the trader for the ICP.
4. Reasons for granting the exemption-The reasons for granting this exemption are:
(a) Granting the exemption meets the requirements of section 11(2) of the Act;
(b) TrustPower would incur extra costs certifying meters and ensuring they comply with the codes of practice for each of the 11 points of connection where the loads are substation loads with low
annual volumes (but over the 3,000 kWh level for unmetered load);
(c) creating new ICP identifiers for each of the
11 substations would impose additional compliance costs for no extra benefit;
(d) TrustPower has stated it will continue to monitor the loads to ensure that annual volume does not exceed 6,000 kWh. Substation load is typically regular and predictable;
(e) TrustPower has advised that if annual volumes exceed 6,000 kWh then it will certify the metering and create new ICPs;
(f) the sites are likely to comply with the new Part
10 threshold (6,000 kWh per annum) for predictable unmetered load when it comes into force on 6 June 2013; and
(g) the exemption will have little or no impact on other participants and service providers, and will not affect any other Code provisions.
