Whereas, pursuant to section 441 of the Maritime Transport Act 1994, the Minister of Transport did delegate those powers, under section 12 of the Submarine Cables and Pipelines Protection Act 1996, to Maritime New Zealand, by an instrument of delegation dated 19 March 1997.
And whereas, pursuant to section 442 of the Maritime Transport Act 1994, Maritime New Zealand did delegate those powers, under section 12 of the Submarine Cables
and Pipelines Protection Act 1996, to the Director of Maritime New Zealand by an instrument of delegation
dated December 2010.
Therefore I, Keith Manch, Director of Maritime New Zealand, hereby declare that the Submarine Cables and Pipelines Protection Order 2009 does not apply in relation to "Area 2" in the Schedule to that Order, during the period starting on 21 January 2012 and ending on 4 February 2012, to any anchoring by the following ships with the following anchors:
- The Kiatoa, with a "Rocna" anchor (15kg);
- The Zella, with a "Bruce" anchor (15kg);
- The Chico, with a "Rocna" anchor (25kg);
- The Brin Wilson, with a "Plough" anchor (15kg).
This notice comes into effect on 21 January 2012.
