Notice of Appointment of Replacement Liquidators
Pursuant to Section 255(2)(a) of the Companies Act 1993
Jeffrey Philip Meltzer and Michael Lamacraft, insolvency practitioners, were appointed joint and several replacement liquidators of RUCTNAS LIMITED (in liquidation) on
15 March 2012 following the resignation of Robert John Knox.
Notice to Creditors to Prove Debts or Claims
Notice is given that the liquidators fix 12 April 2012 as the day on or before which the creditors of the company are to make their claims and to establish any priority their claims may have, under section 312 of the Companies Act 1993, or to be excluded from the benefit of any distribution made before their claims are made or, as the case may be, from objecting to any distribution.
Notice of Meeting of Creditors
Pursuant to section 244(b) of the Companies Act 1993,
a meeting of the creditors of the above-named company
will be held at the offices of Meltzer Mason Heath, Level 16, 7 City Road, Auckland, on 29 March 2012 at 10.00am.
Agenda
1. Liquidators’ report on the proceeding of the liquidation to date.
2. To receive the views of creditors in regard to the company’s affairs.
3. Confirmation of liquidators.
Right to Vote
A creditor cannot vote unless the creditor has lodged a claim in the liquidation and either:
(a) the liquidator has admitted the claim either wholly or in part for payment or for voting purposes; or
(b) the chairperson of the meeting of creditors allows the person to vote in accordance with Regulation 20 of the Companies Act 1993 Liquidation Regulations 1994.
Proxies
Proxies must be completed and deposited at the offices of the liquidators not later than 48 hours before the meeting.
