Land Transfer Act Notice

The applicants described below have applied, under section 70 of the Land Transfer Act 1952, for the removal of a right of way.
The applicants claim the right of way is redundant by reason of the circumstances set out below.
I intend to remove the right of way on 10 March 2011 if no objections have been received before that date.

Applicants: Alexander Huntly Dryburgh and Hazel Winnifred Dryburgh, c/o Maude & Miller, Old McDonald’s Building,
1 Cobham Court, Porirua 5022.
Easement: Right of way marked "J" and "K" on DP 90831 (originally marked "B" on DP 48341), comprised in Computer Freehold Register WN57D/906 (servient tenement) in favour of Lot 1 DP 8106 and Lot 2719 DP 81606 comprised
in Computer Freehold Register WN48A/964 (dominant tenement) specified in Easement Certificate 311436.4 registered
on 19 October 1978.
Circumstances: The dominant tenement has become physically separated from the servient tenement as a result of subdivision shown on DP 81606 and the right of way easement no longer serves the dominant tenement.
