The applicants described below have applied, under section 70 of the Land Transfer Act 1952, for the removal of a right of way easement.
The applicants claim the right of way easement is redundant by reason of the circumstances set out below.
I intend to remove the right of way easement on 15 August 2011, if no objections have been received before that date.
Application: 8808517.
Applicants: Darel Barton and Sherralee Jane Barton, c/o Argyle Welsh Finnigan, Solicitors, 160 Havelock Street (PO Box 454), Ashburton.
Easement: Right of way over part marked "E" and "D" on DPS 33075 specified in Easement Certificate H484218.3 on 2 July 1983.
Circumstances: Part of the dominant land has become physically separated from the servient land as a result of subdivision.
