Pursuant to sections 20(1) and 28 of the Public Works
Act 1981, and to a delegation from the Minister for
Land Information, Ainslie Drysdale, Land Information
New Zealand, declares that, an agreement to that effect having been entered into, the land described in the First Schedule to this notice is hereby acquired for public recreation purposes and the easement in gross described in the Second Schedule to this notice is acquired over the land on the terms and conditions described in the Third Schedule to this notice in connection with obtaining access to and from land held for public recreation purposes and shall vest in the Auckland Council on the date of publication hereof in the New Zealand Gazette.

Second Schedule
Easement to be Acquired
1. "Easement Area" means that part of Lot 1 DP 90270 marked as Area "A" on SO 444731 (Part Computer Freehold Register 169419).
2. Auckland Council shall have a right of way easement in gross over the Easement Area for the purposes of obtaining access to and from the land described in the First Schedule to this notice, together with and subject to the terms and conditions set out in the Third Schedule below.

3. The provisions relating to the easement in gross shall be the implied terms for right of way easements provided for in Schedule 4 of the Land Transfer Regulations 2002 and Schedule 5 of the Property Law Act 2007 except that the Auckland Council’s rights to use the Easement Area shall extend only to its officers, agents, contractors and employees and no other persons.
