ORDER IN COUNCIL

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
Pursuant to section 25 of the Local Government Act 2002, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, makes the following order.
O r d e r
1. Title-This order may be cited as the Local Government (Christchurch City and Selwyn District) Boundary Alteration Order 2011.
2. Commencement-This order comes into force on 18 August 2011.
3. Interpretation-In this order, unless the context otherwise requires:
affected area A means the area labelled A on SO Plan 444083 attached to this order.
affected area B means the area labelled B on SO Plan 444083 attached to this order.
affected area C means the area labelled C on SO Plan 444083 attached to this order.
affected area D means the area labelled D on SO Plan 444083 attached to this order.
affected area E means the area labelled E on SO Plan 444083 attached to this order.
affected area F means the area labelled F on SO Plan 444083 attached to this order.
affected area G means the area labelled G on SO Plan 444083 attached to this order.
affected area H means the area labelled A on SO Plan 444082 attached to this order.
4. Boundary alteration-The boundary between Christchurch City and Selwyn District is altered as follows:
(a) Affected areas A, B, C, D, F and G are excluded from Selwyn District and transferred to Christchurch City; and
(b) Affected areas E and H are excluded from Christchurch City and transferred to Selwyn District.
5. Wards-
(a) Affected areas A, B, C, D, F and G are excluded from the Springs ward of Selwyn District and included in the Riccarton-Wigram ward of Christchurch City.
(b) Affected areas E and H are excluded from the Riccarton-Wigram ward of Christchurch City and included in the Springs ward of Selwyn District.
6. Resource Management Act 1991-
(a) In accordance with section 81 of the Resource Management Act 1991, the Selwyn District district plan continues to apply as the district plan of affected areas A, B, C, D, F and G until such time as Christchurch City Council makes changes to the Christchurch City district plan to cover the affected areas A, B, C, D, F and G.
(b) With respect to affected areas A, B, C, D, F and G any other matters under the Resource Management Act 1991, including proceedings before, or initiated by or against Selwyn District Council shall have effect as matters before, or initiated by or against Christchurch City Council.
(c) In accordance with section 81 of the Resource Management Act 1991, the Christchurch City district plan continues to apply as the district plan of affected areas E and H until such time as Selwyn District Council makes changes to the Selwyn District district plan to cover the affected areas E and H.
(d) With respect to affected areas E and H any other matters under the Resource Management Act 1991, including proceedings before, or initiated by or against Christchurch City Council shall have effect as matters before, or initiated by or against Selwyn District Council.
7. Long-Term Plans and Annual Plans-
(a) The long-term plan and any annual plan prepared under the Local Government Act 2002 by Christchurch City Council apply to affected areas A, B, C, D, F and G, and the long-term plan and any applicable annual plan of Selwyn District Council cease to apply.
(b) The long-term plan and any annual plan prepared under the Local Government Act 2002 by Selwyn District Council apply to affected areas E and H, and the long-term plan and any applicable annual plan of Christchurch City
Council cease to apply.
8. Rates, levies and other monies payable-
(a) All rates, levies and other monies payable, set and assessed, or owing to Selwyn District Council in respect of affected areas A, B, C, D, F and G prior to the commencement date continue to be payable to Selwyn District Council.
(b) On and from the commencement date, all rates, levies and other money payable in respect of affected areas A, B, C, D, F and G, are due and payable to Christchurch City Council.
(c) All rates, levies and other monies payable, set and assessed, or owing to Christchurch City Council in respect of affected areas E and H prior to the commencement date continue to be payable to Christchurch City Council.
(d) On and from the commencement date, all rates, levies and other money payable in respect of affected areas E and H are due and payable to Selwyn District Council.
9. Bylaws-From the commencement date:
(a) The bylaws of Christchurch City Council apply to the affected areas A, B, C, D, F and G, and the bylaws of Selwyn District Council cease to apply to those affected areas; and
(b) The bylaws of Selwyn District Council apply to affected areas E and H, and the bylaws of Christchurch City Council cease to apply to the affected areas E and H.
10. Provisions that apply to all reorganisation schemes-Except as provided for in this order, clause 67 of Schedule 3 of the Local Government Act 2001 applies in respect of this order.
