Final Determination of Dumping Investigation: Wire Nails From the People’s Republic of China

Pursuant to section 13 of the Dumping and Countervailing Duties Act 1988 ("the Act"), I hereby give notice that I have made a final determination that, in relation to the importation or intended importation of the goods specified in the First Schedule to this notice ("the subject goods"):
(a) the subject goods are being dumped; and
(b) by reason thereof, material injury to the New Zealand industry has been and is being caused.
Notice is hereby given that, acting pursuant to sections 14(1) and 14(4) of the Act, I have determined the amount of
anti-dumping duty to be imposed on the subject goods to be the rates set out in the Second Schedule to this notice.
Notice is also given that the subject goods manufactured by the companies named in the Third Schedule to this notice will not be subject to anti-dumping duty as they were found not to be exporting the subject goods to New Zealand at dumped prices.

The People’s Republic of China (China)
Description of Goods
Wire nails of iron or steel, bright (plain) and galvanised (coated), excluding wire nails that meet any of the following criteria:
- Those made of stainless steel;
- those equal to or greater than 155mm in length;
- those equal to or greater than 7mm in diameter;
- those that are collated or for collation;
- horseshoe nails.
The goods are currently classified under New Zealand Customs Tariff Item 7317.00.09 and Statistical Key 09D, which classification is provided for convenience and Customs purposes only, the written description being dispositive.
Second Schedule
Amount of Anti-dumping Duty
The amount of anti-dumping duty to be paid on demand, in respect of each importation of wire nails imported or intended to be imported into New Zealand from China, shall be the ad valorem percentage rates specified below which shall be applied to the value for duty of the goods.

Third Schedule
Exporters Exempt From Anti-dumping Duty
The following Chinese manufacturers were found not to
be exporting the subject goods to New Zealand at dumped prices. Subject goods manufactured by these companies and exported to New Zealand will not be subject to anti-dumping duty:
Huafeng Metal Production Co. Ltd
Tianjin Baisheng Metal Products Co. Ltd
Shanghai Puying Architecture Hardware Co. Ltd
