Authorised Access to Certain Names and Addresses Held on the Motor Vehicle Register

Pursuant to section 241 of the Land Transport Act 1998 ("the Act"), I authorise the following person, for the purpose and the term, and on the conditions stated below, to have access to the names and addresses of persons:
- who are currently registered in respect of a motor vehicle(s); and
- who have not instructed the Registrar of Motor Vehicles to withhold their details.
Person Purpose Term
Information Logistics Company Limited To provide names and addresses to customers who themselves hold an authorisation under section 241 or who have a right to such information under other legislation (for example, for enforcement of the law under the Land Transport Act 1998). 1 May 2011 to 30 April 2016 inclusive
Conditions
(a) The names and addresses are accessed only by clients of Information Logistics Company Limited, whose use of the information is regulated by contract with the applicant, on the client’s own behalf and solely for the client’s own use;
(b) The names and addresses are accessed only for the specified purpose;
(c) The fees charged for the provision of the names and addresses from the Motor Vehicle Register are duly paid;
(d) Information Logistics Company Limited must require and enforce, as a term of its contractual agreement with its clients, that its clients only access names and addresses from the Motor Vehicle Register for the specified purpose, or for a purpose set out in section 235 of the Act, and must inform its clients of this condition;
(e) Any identified instances of unauthorised access are immediately notified to the Secretary for Transport and the Privacy Commissioner;
(f) Before being permitted to access the Motor Vehicle Register under section 241 of the Act, all Information Logistics Company Limited staff must receive training that emphasises that such access must only be for the specified purpose, and refresher training of all staff also must be undertaken at appropriate intervals;
(g) Access by Information Logistics Company Limited staff must be restricted solely to members of staff for whom authorised access is essential;
(h) The names and addresses obtained by clients under this authorisation shall not be disclosed to any third party unless such disclosure is necessarily incidental to achieving the specified purpose;
(i) Information Logistics Company Limited must provide an annual report to the Secretary for Transport on Information Logistics Company Limited’s compliance with the conditions set out in this notice by 1 May each year beginning with 1 May 2012 (this requirement may be incorporated into the company’s usual audit practices); and
(j) The terms and conditions, if any, imposed by the New Zealand Transport Agency for access to Motor Vehicle Register information.
