Telecommunications Act 2001 and Section 73 of the Telecommunications (TSO, Broadband, and Other Matters) Amendment Act 2011: Notification of Final Decision to Geographically Average Certain Prices for the Designated Access Services of Chorus's Unbundled Bitstream Access Service and Chorus's Unbundled Copper Local Loop Network Service

The Commerce Commission ("Commission") made standard terms determinations, under section 30M of the Telecommunications Act 2001 ("the Act"), in respect of
the following designated access services of:
- Telecom's unbundled copper local loop network (UCLL) on 7 November 2007 (Decision 609);
- Telecom's unbundled bitstream access (UBA) on
12 December 2007 (Decision 611); and
- Telecom's unbundled copper local loop network
service (Sub-loop UCLL), Telecom's unbundled copper local loop network co-location service (Sub-loop
Co-location) and Telecom's unbundled copper local
loop network backhaul service (distribution cabinet to telephone exchange) (Sub-loop Backhaul) on 18 June 2009 (Decision 672 - with these services collectively referred to as the Sub-loop Services).
On 7 July 2001, the Commission gave public notice that
it had commenced a review of the pricing set out in Decisions 609, 611 and 672 for the purpose of making
any changes to those determinations that may be necessary for the purpose of implementing clause 4A of subpart 1 of Part 1 of Schedule 1.
Clause 4A requires the Commission to determine a geographically averaged price for Chorus's unbundled bitstream access service and Chorus's unbundled copper local loop network service. This review was required by sections 73(1) and 73(2)(b) of the Telecommunications (TSO, Broadband, and Other Matters) Amendment Act 2011 ("Amendment Act").
Pursuant to section 73(2)(c) of the Amendment Act and section 30R(5)(d) of the Act, the Commission gives public notice that it has released its final decision to make necessary changes to Decisions 609, 611 and 672 for the purpose of implementing clause 4A of subpart 1 of Part 1 of Schedule 1.
This decision will have effect from separation day as that term is defined in the Amendment Act.
