Proposed Variation to the Retirement Villages Code of Practice 2008

I give notice that, in accordance with section 91 of the Retirement Villages Act 2003, I invite written submissions on proposed variations to the Code of Practice to be received at my office by 5.00pm on Monday 21 November 2011.
The proposed variations to the Code of Practice are to:
- Clause 22: Fire and accidental damage - including insurance cover, repair and reinstatement of property and temporary accommodation;
- Clause 47: Grounds for termination if the unit is damaged or destroyed though no fault; and
- Clause 54: Payments due to the resident on termination or end of occupation - including charges.
There are also some proposed additions to the definitions section (clause 2) relating to the issues in the proposed variations.
The proposed variations I am consulting on have been received from:
- The Association of Residents of Retirement Villages (Auckland Region);
- The Retirement Villages Association; and
- The Department of Building and Housing.
This consultation is being undertaken jointly with the Department of Building and Housing.
