Pursuant to section 11 of the Electricity Industry Act 2010, the Electricity Authority gives the following notice.
N o t i c e
1. Title and commencement-(1) This notice is the Electricity Industry (Exemption No. 135 (TrustPower Limited)) Exemption Notice 2011.
(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.
2. Exemption-TrustPower Limited ("TrustPower") is exempted from compliance with clause 10.3(a)(i) and 10.3(b) of the Electricity Industry Participation Code 2010 ("Code") for ICPs 0000179857TR384, 0000176916TRD00, and 0000195313TR5D8.
3. Term-This exemption expires at the close of
30 November 2011.
4. Reasons for granting the exemption-The reasons for granting this exemption are:
(a) electricity cannot be left disconnected without causing public transport to fail in Wellington;
(b) the cost of complying with the metering requirements of the Code for a temporary installation are unreasonable;
(c) TrustPower can calculate consumption with some degree of accuracy from historic data; and
(d) TrustPower will submit estimated reconciliation information to the Reconciliation Manager in accordance with the Code for reconciliation so other participants will not be significantly disadvantaged.
