Pursuant to section 11 of the Electricity Industry Act 2010, the Electricity Authority ("Authority") gives the following notice.
N o t i c e
1. Title and commencement-(1) This notice is the Electricity Industry (Exemption No. 131 (TrustPower Limited)) Exemption Notice 2011.
(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.
2. Exemption-TrustPower Limited ("TrustPower") is exempted from compliance with clause 13(2) of Schedule 15.5 of the Electricity Industry Participation Code 2010 ("Code").
3. Term-This exemption expires at the close of 31 May 2013.
4. Reasons for granting the exemption-The reasons for granting this exemption are:
(a) No other participant has alleged a breach (the industry is currently working around the issue);
(b) TrustPower’s new internal system will ensure compliance with the Code and it will not be pragmatic for TrustPower to update its current system; and
(c) TrustPower’s key information is being submitted to the Reconciliation Manager in accordance with the Code.
