Declaration Under the Submarine Cables and Pipelines Protection Act 1996

Whereas, pursuant to section 441 of the Maritime Transport Act 1994, the Minister of Transport did delegate the
power to make a declaration under section 12(6) of
the Submarine Cables and Pipelines Protection Act 1996
to Maritime New Zealand, by an Instrument of Delegation dated 19 March 1997.
And whereas, pursuant to section 442 of the Maritime Transport Act 1994 and section 73 of the Crown Entities Act 2004, Maritime New Zealand did delegate the
power under section 12(6) of the Submarine Cables and Pipelines Protection Act 1996 to the Director of Maritime New Zealand, by an Instrument of Delegation dated
17 January 2008.
Therefore I, Catherine Taylor, Director of Maritime
New Zealand, hereby declare as follows:
D e c l a r a t i o n
The Submarine Cables and Pipelines Protection Order 1992 (SR 2009/14) shall not apply in respect of the following vessel:
Pacific Hideaway
for the period 21 February 2011 to 26 February 2011 (inclusive), subject to the following conditions:
1. The declaration shall only apply when Pacific Hideaway is in the protected area designated "Area 2 - Hauraki Gulf" for the purpose of survey of the wreck RMS Niagara;
2. Pacific Hideaway must be operated by SeaROV Technologies Limited;
3. Operations on the wreck site shall only be carried out
in daylight hours and in wind conditions not exceeding
15 knots;
4. While operating Pacific Hideaway within the Protected Area designated "Area 2 - Hauraki Gulf", SeaROV Technologies Limited must comply with the conditions specified by Telecom New Zealand Limited on 8 May 1997.
This declaration comes into effect on and from the time of the publication of this notice on 17 February 2011.
