Notice of Appointment of Receiver of Income
Trustees Executors Limited ("the mortgagee") is the mortgagee under memoranda of:
1. Mortgage 6138890.4 (North Auckland Land Registry) dated 6 September 2004 given by BAMBOO TWO LIMITED (in liquidation) ("the mortgagor") in favour of the mortgagee and affecting the land in certificate of title 119927 (North Auckland Land Registry), being the property known as 25/23 Hargreaves Road, Ponsonby, Auckland ("the Hargreaves Land");
2. Mortgage 6496876.4 (North Auckland Land Registry) dated 15 July 2005 given by the mortgagor in favour of the mortgagee and affecting the land in certificates
of title 197359 and 197360 (North Auckland Land Registry), being the properties known as Units 1213
and 1214, 139 Hobson Street, Auckland Central
("the Hobson Land");
3. Mortgage 5701574.3 (North Auckland Land Registry) dated 21 August 2003 given by the mortgagor in favour of the mortgagee and affecting the land in certificates of title 72756, 72768 and 72769 (North Auckland Land Registry), being the properties known as Units 6G,
7F and 7G, 508 Queen Street, Auckland Central
("the Queen Land"); and
4. Mortgage 5308211.8 (North Auckland Land Registry) dated 7 August 2002 given by the mortgagor in favour
of the mortgagee and affecting the land in certificates of title NA139D/977 and NA139D/982 (North Auckland Land Registry), being the properties known as 3B and 4B, 109 Vincent Street, Auckland Central ("the Vincent Land").
The mortgagor is in default under each of the mortgages; and the mortgagee is entitled to appoint a receiver of the income from the Hargreaves Land, Hobson Land, Queen Land and Vincent Land or any part of it, upon such default.
The mortgagee hereby appoints Patrick Tseng, of AJS Rental Realty Limited, to be receiver of the income of each of the Hargreaves Land, the Hobson Land, the Queen Land and the Vincent Land with all the powers conferred upon a receiver in terms of the relevant mortgage and by the law.
The receiver shall at all times be the agent of the mortgagor and not the mortgagee.
