Land Transfer Act Notice

The applicant described below has applied under section 70 of the Land Transfer Act 1952 for the removal of a drain sewage easement.
The applicant claims the drain sewage easement is redundant by reason of the circumstances set out below.
I intend to remove the drain sewage easement on 21 October 2010 if no objections have been received before that date.

Applicant: Lockyer Family Trustee Limited, c/o Impact Legal, PO Box 10660, Wellington 6143.
Easement: Right to drain sewage over part marked "B" on DP 381838 comprised in Computer Freehold Register 327614 created by Transfer B756302.3 registered on 23 November 1999.
Circumstances: The dominant tenement has become physically separated from the servient tenement as a result of subdivisions shown on DP 88443 and DP 90908 and the easement no longer serves the dominant tenement.
