The applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the removal of a right of way easement.
The applicant claims the right of way easement is redundant by reason of the circumstances set out below.
I intend to remove the right of way easement on 31 May 2010 if no objections have been received before that date.

Applicant: St Albans Shirley Club (Incorporated), c/o 269 Hills Road, Shirley, Christchurch.
Easement: Right of way over Lot 1 DP 83277; marked "H" on DP 83277 and marked "D" and "E" on DP 47111 (comprised in Computer Freehold Register CB48A/853) as appurtenant to Lots 1-3 DP 303164 (comprised in Computer Freehold Registers 12498-12500) and Lots 1 and 2 DP 330300 (comprised in Computer Freehold Registers 124476 and 124477) and Lots 5-11 DP 303164 (comprised in Computer Freehold Registers 12502-12508), created by Transfer 488709 registered on 8 October 1958 and easement certificate registered on 18 July 1984.
Circumstances: The dominant land has become physically separated from the servient land as a result of subdivision in DP 83277 and the easement no longer serves the dominant tenement.
