Imposition of Moratorium on Resource Consent Applications to Take, Use, Dam or Divert Water in the Waiau Catchment

At an ordinary council meeting held on 24 November 2010, Environment Canterbury (The Canterbury Regional Council) ("the Council") resolved to impose a moratorium on applications for resource consents for water within the Waiau Catchment.
The Council’s resolution is:
"That pursuant to Section 34 of the Environment Canterbury (Temporary Commissioners and Improved Water Management) Act 2010, the Canterbury Regional Council resolves:
(a) To place a moratorium on resource consent applications made under s. 14 of the Resource Management Act 1991, to take, use, dam or
divert surface water or hydraulically connected groundwater within the Waiau Catchment - being the Waiau River from source to its confluence with the sea as shown on NZMS 260 O33 at grid reference 4075 2557, and all its tributaries.
(b) That for the purposes of this moratorium, hydraulically connected groundwater is defined as any water take which has a moderate or high connectivity to surface water in the Waiau Catchment, or a low connectivity and the take
is 5l/s or greater; when measured using any one of the approved methods in the proposed Natural Resources Regional Plan.
(c) That the moratorium be imposed from 6 December 2010 until 1 October 2011."
The Council may, under section 36 of the Environment Canterbury (Temporary Commissioners and Improved Water Management) Act 2010, end the moratorium sooner.
