Under the Conservation Act 1987, the Conservator for the Otago Conservancy of the Department of Conservation declares that the land described in the First Schedule is
held for conservation purposes and further declares the conservation area to be set apart as a reserve, classified as
a scenic reserve, included in the reserve described in
the Second Schedule, subject to the Reserves Act 1977
and, under the Reserves Act 1977, to be vested in the Yellow-Eyed Penguin Trust in trust for that purpose.
