Notice of Intention to Take Land for Roading, Car Parking and Urban Renewal Purposes-30 Totara Avenue, New Lynn, Waitakere City

Notice is hereby given in accordance, with section 23(1)(b) of the Public Works Act 1981, that the Waitakere City Council ("the Council") proposes to take all of the land situated at
30 Totara Avenue, New Lynn, Waitakere City, and more particularly described in the Schedule hereto ("the land").
The land is required for roading, car parking and urban renewal purposes.
The reasons why the Council considers it is reasonably necessary to take this interest in the land described in the Schedule are:
(a) to meet the agreed objectives embodied in the Waitakere City Council’s District Plan Change 17, that will enable New Lynn to meet the needs of a modern town centre; and
(b) to achieve the objectives of the New Lynn Transit Oriented Development project and assist in the regeneration of the New Lynn town centre.
The owners of the land and those persons with a registered interest in it have been served with notice of the Council’s intention to take the land and of their right to object.
Any other person having a right to object to the proposed taking of the said land may forward a written objection to the Registrar, Environment Court, Department of Courts, PO Box 7147, Wellesley Street, Auckland 1141, or to Level 8, 3 Kingston Street, Auckland, within 20 working days of the date of publication of this notice.
If any objection is made in accordance with this notice, a public hearing will be held.
The objector will have a right to appear and be heard personally unless the objector otherwise requires.
Each objector will be informed of the time and place of the hearing.

The land to be taken is:
The freehold interest in 30 Totara Avenue, New Lynn, Waitakere City, which is legally described as:
(a) 324 square metres being Part Allotment 257 Parish of Waikomiti comprised and described in Computer Freehold Register NA599/155 - limited as to parcels; and
(b) 379 square metres being Part Allotment 257 Parish of Waikomiti comprised and described in Computer Freehold Register NA599/286 - limited as to parcels.
