Notice of Intention to Take Land and Other Interests-for the State Highway 74 QEII Drive/ Marshland Road Intersection Upgrade, Christchurch City

Notice is hereby given that the Crown, under the provisions of section 23 of the Public Works Act 1981, proposes to take the land described in the First Schedule to this notice ("the land") and the leasehold estate in the land described
in the Second Schedule to this notice on the terms and conditions set out in the Third Schedule to this notice.
The land and the leasehold estate are required for the
State Highway 74 QEII Drive/Marshland Road Intersection Upgrade.
The land firstly described in the First Schedule is required for the functioning indirectly of a road and will be used for the widening of Marshland Road, and will be vested in the Christchurch City Council as road following acquisition.
The land secondly described in the First Schedule is required for the functioning indirectly of a road (segregation strip).
The leasehold estate described in the Second Schedule is required for temporary occupation during construction of the project.
The project is required to cater for increasing traffic volumes and to improve the safety and efficiency of State Highway 74 and the local road network.
The owner of the land and those persons with a registered interest in it have been served with notice of the Crown’s intention to take their land and their right to object.
Any other person having the right to object may send a written objection to the Registrar, Environment Court,
89 Armagh Street, Christchurch 8011, or by post to PO Box 2069, Christchurch 8140, within 20 working days after the date of publication of this notice.
If any objection is made in accordance with this notice, a public hearing will be held with the right of the objector to appear and be heard personally unless the objector otherwise requires, and each objector will be informed of the time and place of the hearing.

Third Schedule
Purpose for which leasehold estate is required
The leasehold estate is required over the land referred to in the Second Schedule ("the land") to allow the Crown to occupy it during the construction of the State Highway 74 QEII Drive/Marshland Road Intersection Upgrade:
(a) To construct a replacement access and entranceway; and
(b) To construct a 1 metre high earthbund and fencing.
("the Mitigation Works")
Terms of the leasehold estate
1. The leasehold estate shall have a term of three years, commencing on the 14th day after the date of publication of the Proclamation in the New Zealand Gazette.
2. Notwithstanding the term created, the Crown may terminate the leasehold estate at any time by giving the lessor one month’s notice in writing.
3. The Crown shall have the right to occupy the land, including the right to enter and re-enter the land at all times, with or without such vehicles, machinery or materials for the purpose set out in this notice.
4. The Crown shall complete the mitigation works generally in accordance with the attached plan P03-01 Rev 02.
5. The Crown shall take all reasonable steps to minimise disruption to the access to the balance of the land held in Computer Freehold Register CB12K/1319 during the Project.
