Restriction on Erection of Structures State Highway 1, Inner City Bypass, Wellington City

Pursuant to section 236 of the Public Works Act 1981, and
to a delegation from the Minister for Land Information, Stephen Robert Gilbert, Land Information New Zealand, declares the land described in the Schedule ("the land") to be subject to the following restriction:
1. The design of any new development upon the land
must take into account the urban design principles described in the Bypass Design Guide, a copy of which is attached as the Sixth Schedule to the Memorandum of Agreement made between the Crown and Wellington City Council dated 12 January 2005, such agreement being recorded against Computer Freehold Register WN934/47 by compensation certificate 6279699.1, and such certificate entitling any person who applies at the place and within the hours described in the certificate to be shown a copy of the agreement including the Bypass Design Guide.
2. No new development shall be completed on the land without the consent of the Crown unless:
2.1 the development has been approved by the Wellington City Council as a Controlled Activity prior to the Bypass Design Guide being incorporated into the Wellington City Council District Plan; or
2.2 the Bypass Design Guide has previously been incorporated into the Wellington City Council District Plan.
3. In this notice, "development" means the erection of any structure for which a resource consent or building consent is required.
