Pursuant to section 60 of the Fisheries Act 1996, the Minister of Fisheries and Aquaculture, after consultation with persons or organisations considered representative of those classes of persons having an interest provided in section 60, and after consideration of the matters specified in section 60(3) of the Fisheries Act 1996, gives the following notice.
N o t i c e
1. Title and commencement-(1) This notice is the Fisheries (Quota Aggregation Limit Exemption) Notice 2010.
(2) This notice shall come into effect on the day after its notification in the New Zealand Gazette.
2. Interpretation-In this notice, "Burkhart Fisheries" means Burkhart Fisheries Limited, Lanfar Holdings (No.4) Limited, Trevor Milton Burkhart, Dennis Lindsay Burkhart, Denbar Investments Limited, Lobster (NZ) Limited, and includes any persons associated with these persons
and companies in terms of section 59(10) of the Fisheries Act 1996.
3. Exemption to quota aggregation limit-From the date that this notice comes into effect, consent is given for Burkhart Fisheries to hold quota shares for rock lobster
in quota management area 5 up to the limit of 26,890,000 quota shares.
4. Revocation-The Fisheries (Quota Aggregation Limit Exemption) Notice (No. 2) 2005 (No. F347), published in the New Zealand Gazette, 20 October 2005, No. 177, page 4498, is revoked.
