Instrument Amending the Special Needs Grants Programme and the Recoverable Assistance Programme 2010

Pursuant to section 124(1)(d) of the Social Security Act 1964, I make the following Instrument.

I n s t r u m e n t
1. Title-This Instrument is the Instrument Amending the Special Needs Grants Programme and the Recoverable Assistance Programme 2010.
2. Commencement-(1) This Instrument, except clause 4, comes into effect on 1 July 2010.
(2) Clause 4 comes into effect on 31 January 2011.
3. Amendments relating to financial assistance for obtaining/renewing a driver licence-The welfare programmes set out in Schedule 1 are amended in the manner set out in that Schedule.
4. Amendments relating to financial assistance for reinstatement of a driver licence-The welfare programmes set out in Schedule 2 are amended in the manner set out in that Schedule.

Clause 3
Special Needs Grants Programme and the Recoverable Assistance Programme amended
Special Needs Grants Programme (as approved on 18 December 1998)
1. Clause Amended
Clause 3 is amended by the revoking the definition of "Driver Licence" and substituting:
""Driver Licence" means either a learner licence, restricted licence or full licence, issued under the Land Transport (Driver Licensing) Rule 1999, but excludes any endorsement:"
2. New Clauses Substituted
(1) Clause 17A.1.2 is revoked, and the following clause substituted:
"17A.1.2A The amount of any Grant made under clause 17A.1.1 must not exceed the actual cost for renewal of a Driver Licence under the Land Transport (Driver Licensing and Driver Testing Fees) Regulations 1999."
(2) Clause 17A.2.4 is revoked, and the following clause substituted:
"17A.2.4A The amount of any Grant made under clause 17A2.1 must not exceed the actual cost for obtaining a Driver Licence under the Land Transport (Driver Licensing and Driver Testing Fees) Regulations 1999."
Recoverable Assistance Programme (as approved on 15 February 1999)
3. Clause Amended
Clause 3 is amended by revoking the definition of "Driver Licence" and substituting:

4. New Clauses Substituted
(1) Clause 12A.1.2 is revoked, and the following clause substituted:
"12A.1.2A The amount of any Payment made under clause 12A.1.1 must not exceed the actual cost for renewal of a Driver Licence under the Land Transport (Driver Licensing and Driver Testing Fees) Regulations 1999."
(2) Clause 12A.2.4 is revoked, and the following clause substituted:
"12A.2.4A The amount of any Payment made under clause 12A.2.1 must not exceed the actual cost for obtaining a Driver Licence under the Land Transport (Driver Licensing and Driver Testing Fees) Regulations 1999)."

Special Needs Grants Programme and the Recoverable Assistance Programme amended
Special Needs Grants Programme (as approved on 18 December 1998)
1. New Clauses Inserted
The following clause is inserted after clause 17A.2.2:
"17A.3 Reinstating driver licences
17A.3.1 The Chief Executive may make a Grant to an Applicant for the fee for reinstatement of a Driver Licence
if the Applicant-
(a) has had his or her Driver Licence disqualified and/or surrendered; and
(b) is eligible to have his or her Driver Licence reinstated under the Land Transport (Driver Licensing) Rule 1999.
17A.3.2 The amount of any Grant made under clause 17A3.1 must not exceed the fee for reinstatement under the Land Transport (Driver Licensing and Driver Testing Fees) Regulations 1999.
17A.3.3 The Chief Executive may make one Grant under clause 17A3.1 to each of the Applicant and his or her spouse or partner during a 52 week period."
Recoverable Assistance Programme (as approved on 15 February 1999)
2. New Clauses Inserted
The following clauses are inserted after clause 12A2.1:
"12A.3 Reinstating driver licences

Explanatory Note
This note is not part of the Instrument, but is intended to indicate its general effect.
This Instrument which generally comes into effect on 1 July 2010, amends the Special Needs Grants Programme and the Recoverable Assistance Programme.
Clause 3 and Schedule 1 makes amendments to ensure that the amounts payable for obtaining and renewing a driver licence correspond to the actual cost under the Land Transport (Driver Licensing and Driver Testing Fees) Regulations 1999.
Clause 4 which comes into effect on 31 January 2011 and Schedule 2 establishes a payment for the new licence reinstatement fee.
