Notification of Oreti Mataitai Reserve and Appointment of Tangata Tiaki/Kaitiaki (No. F544)

Pursuant to Regulation 22 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Chief Executive of the Ministry of Fisheries gives the following notice:
Pursuant to Regulation 20, by a notice published in the
New Zealand Gazette, 10 June 2010, No. 64, page 1849,
the Minister of Fisheries and Aquaculture declared a mataitai reserve over the fisheries waters along Oreti Beach between the Waimatuku River and the New River Estuary, west of Invercargill.
The Minister of Fisheries and Aquaculture, in an instrument dated on the 31st day of May 2010, appointed Michael Richard Skerrett and Cyril Raymond Gilroy as Tangata Tiaki/Kaitiaki for the mataitai reserve.
The appointment is for a term of five years.
The mataitai reserve and appointment of Tangata
Tiaki/Kaitiaki take effect from 8 July 2010.
The Oreti Mataitai Reserve includes all fisheries waters along Oreti Beach lying inside a line:
(a) commencing at a point on the mean high water mark (MHWM) at the Waimatuku River at 46°21.47'S and 168°08.98'E; then
(b) proceeding in a straight line generally in a
south-easterly direction for approximately 1.5 nautical miles to a point 0.5 nautical miles
offshore from MHWM at 46°22.79'S and 168°09.85'E; then
(c) proceeding generally in a south-easterly direction following that 0.5 nautical mile mark to a point offshore at 46°30.31'S and 168°15.60'E; then
(d) proceeding generally in a north-easterly direction to a point on the MHWM at the New River Estuary at 46°30.02'S and 168°16.50'E; and then
(e) proceeding along the MHWM to the point of commencement.
Commercial fishing within the mataitai reserve is prohibited under Regulation 24(2) of the Fisheries (South Island Customary Fishing) Regulations 1999.
The Tangata Tiaki/Kaitiaki may authorise any individual to take fish, aquatic life or seaweed for customary food gathering purposes from within the whole or any part of the mataitai reserve.
No fishing for customary food gathering purposes may take place in the mataitai reserve without authorisation from the Tangata Tiaki/Kaitiaki.
