Fisheries (Kaimoana Customary Fishing) Notice (No. 7) 2010 (No. F532)

Pursuant to Regulations 9 and 10 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Deputy Chief Executive Fisheries Management at the Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.
N o t i c e
1. Title and commencement-(1) This notice may be cited as the Fisheries (Kaimoana Customary Fishing) Notice (No. 7) 2010.
(2) This notice shall come into effect on 4 June 2010.
2. Interpretation-In this notice:
(a) "whangai-tai" and "mahinga kai" are local dialect words that have the same meaning as "customary food-gathering", a term that is defined in the Fisheries (Kaimoana Customary Fishing) Regulations 1998.
(b) "Tchakat Kitaki" and "Tangata Kaitiaki" are local dialect words that have the same meaning as "Tangata Kaitiaki/Tiaki", a term that is defined
in the Fisheries (Kaimoana Customary Fishing) Regulations 1998.
(c) "Tchakat Kitaki" and "Tangata Kaitiaki" means the person or persons appointed under Regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 for the management of either whangai-tai or mahinga kai within the area/rohe moana.
(d) "area/rohe moana" means all fisheries waters (including inland waters) enclosed by a line with each point being 200 nautical miles from the mean high-water mark of all islands in the Chatham Islands Group.
3. Request to cancel appointment-The Pa Tangaroa Fisheries Forum, acting for Moriori and Ngati Mutunga being the tangata whenua who nominated Leon Goomes as
a Tchakat Kitaki for the area/rohe moana, has requested in writing the cancellation of his appointment as a Tchakat Kitaki.
4. Cancellation of appointment-On 3 May 2010, the Minister of Fisheries and Aquaculture cancelled, under Regulation 10(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of Leon Goomes as a Tchakat Kitaki for managing whangai-tai within the area/rohe moana.
5. Nomination of Tangata Kaitiaki-The Pa Tangaroa Fisheries Forum, acting for Moriori and Ngati Mutunga, has nominated Celine Gregory-Hunt as a Tangata Kaitiaki for managing mahinga kai within the area/rohe moana.
6. Appointment of Tangata Kaitiaki-On 3 May 2010, the Minister of Fisheries and Aquaculture confirmed, under Regulation 9(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of Celine Gregory-Hunt as a Tangata Kaitiaki for managing mahinga kai within the area/rohe moana.
7. Confirmation of tangata whenua-Moriori and Ngati Mutunga, as represented in terms of this appointment by the Pa Tangaroa Fisheries Forum, are confirmed as the tangata whenua of the area/rohe moana to which the appointment of Tchakat Kitaki and Tangata Kaitiaki relates.
8. Power to authorise the taking of fisheries resources for whangai-tai or mahinga kai-A Tchakat Kitaki or Tangata Kaitiaki appointed for the area/rohe moana may authorise any individual to take fisheries resources, managed under the Fisheries Act 1996, for whangai-tai
or mahinga kai purposes from within the whole or any part of the area/rohe moana. No whangai-tai or mahinga kai of fisheries resources may take place in the area/rohe moana without an authorisation from either a Tchakat Kitaki or a Tangata Kaitiaki.
