Fisheries (Kaimoana Customary Fishing) Notice (No. 3) 2010 (No. F518)

Pursuant to Regulations 9 and 10 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Acting Customary Relationship Manager (Deed of Settlement Implementation Programme) at the Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

1. Title and commencement (1) This notice may be cited as the Fisheries (Kaimoana Customary Fishing) Notice (No. 3) 2010.
(2) This notice shall come into effect on 26 February 2010.
2. Interpretation In this notice:
(a) "mahinga mataitai" are local dialect words that have the same meaning as "customary food-gathering",
a term that is defined in Regulation 2 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998.
(b) "Kaitiaki" is a local dialect word that has the same meaning as "Tangata Kaitiaki/Tiaki", a term that is defined in Regulation 2 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998.
(c) "Kaitiaki" means the person or persons appointed under Regulation 9 or 10 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 for the management of mahinga mataitai within the area/rohe moana.
(d) "area/rohe moana" means the area described by a line commencing:
(i) at a point on the coastline at Paritu (38°57.0'S and 177°54.2'E); then
(ii) due east for 200 nautical miles to a point (38°57.0'S and 177°25.0'W); then
(iii) due south to a point (43°15.0'S and 177°25.0'W); then
(iv) 45° north-west to a point (39°18.6'S and 177°45.0'E); then
(v) due north to a point (39°13.3'S and 177°44.9'E); then
(vi) generally north-easterly to a point on
the coastline at Waikokopu (39°04.4'S and 177°49.6'E); then
(vii) generally northerly along the mean high-water springs mark to the point of commencement.
The geographical coordinates named are in terms
of the WGS84 datum.
3. Request to cancel an appointment The Mahia Maori Committee, acting for the whanau, hapu and marae of Rongomaiwahine, being the tangata whenua who nominated Tohu Kereru as a Kaitiaki for the area/rohe moana, has requested in writing the cancellation of his appointment as a Kaitiaki for Ruawharo Marae.
4. Cancellation of appointment On 3 February 2010, the Minister of Fisheries cancelled, under Regulation 10(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of Tohu Kereru as a Kaitiaki for managing customary food-gathering within the area/rohe moana.
5. Nomination of Kaitiaki The Mahia Maori Committee, acting for the whanau, hapu and marae of Rongomaiwahine, has nominated Aaron Raureti as a replacement Kaitiaki for managing mahinga mataitai within the area/rohe moana
for Ruawharo Marae; and Edward Hammond and Te Hira Whati as additional Kaitiaki for managing mahinga mataitai within the area/rohe moana for Te Rakato Marae.
6. Appointment of Kaitiaki On 3 February 2010, the Minister of Fisheries appointed, under Regulation 10(2) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, Aaron Raureti as a replacement Kaitiaki for managing mahinga mataitai within the area/rohe moana.
On 3 February 2010, the Minister also confirmed, under Regulation 9(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of Edward Hammond and Te Hira Whati as additional Kaitiaki for managing mahinga mataitai within the area/rohe moana.
7. Confirmation of tangata whenua The whanau, hapu and marae of Rongomaiwahine, as represented by the Mahia Maori Committee, are confirmed as the tangata whenua of the area/rohe moana to which the appointment of Kaitiaki relates.
8. Power to authorise the taking of fisheries resources for mahinga mataitai A Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996 for mahinga mataitai purposes from within the whole or any part of the area/rohe moana. No mahinga mataitai of fisheries resources may take place in the area/rohe moana without an authorisation from a Kaitiaki.
