New Zealand Transport Agency (Heavy Motor Vehicles on State Highways) Bylaw 2010/HMV

Pursuant to section 61(3) of the Government Roading Powers Act 1989, the New Zealand Transport Agency hereby makes the following bylaw.

1. Title and commencement-This bylaw may be cited as the New Zealand Transport Agency (Heavy Motor Vehicles on State Highways) Bylaw 2010/HMV and shall come into force at 1.00am on Saturday 4 December 2010.
2. Interpretation-In this bylaw, "heavy motor vehicle" means a motor vehicle (other than a motorcar that is not used, kept or available for the carriage of passengers for hire or reward) the gross laden weight of which exceeds 4,500 kilograms; but does not include a vehicle designed solely or principally for the use of fire brigades in attendance at fires.
3. The driving or taking of any heavy motor vehicle or combination of heavy motor vehicles on to or over the sections of State highway described in the First Schedule
to this bylaw while there is another heavy motor vehicle or combination of heavy motor vehicles on that section of State highway is prohibited.
4. No person shall take or permit to be driven or taken, any heavy motor vehicle on any road or part of a road specified in the Second Schedule to this bylaw between the hours
of 7.00am and 7.00pm, unless that vehicle is used for the express purpose of:
(a) providing an emergency service on a road, or part
of a road, specified in the Second Schedule, or in
the immediate vicinity of that road or part of that road; or
(b) the provision or maintenance of a network utility work on or in a road or part of a road, specified in the Second Schedule, or in the immediate vicinity of that road, or part of that road, provided that the provision or maintenance of that network utility is undertaken by a network utility operator as defined in section 166 of the Resource Management Act 1991; or
(c) delivering or collecting people and/or goods to or from a property with frontage to a road or part of a road specified in the Second Schedule to this bylaw.

5. The following bridges on State Highway 6 (Blenheim-Invercargill):
- The Fox Bridge (Route Position 626/8.28)
- The Cook Bridge (Route Position 639/0.00)
- The Karangarua Bridge (Route Position 659/0.00)
The following bridge on State Highway 7A (Hanmer Springs Road):
- The Waiau Ferry Bridge (Route Position 0/0.8)
Second Schedule
6. That section of State Highway 12 (Broadway) at Kaikohe in Far North District, from Mangakahia Road
to Rankin Street (Route Position 0/10.272 to Route Position 0/11.081); a distance of 809 metres.
7. Revocation-The Transit New Zealand Bylaw
(Heavy Motor Vehicles on State Highways) 2002/17 and
all its amendments* are hereby revoked at 1.00am on Saturday 4 December 2010.
8. Authority to make bylaw-This bylaw is made by the Group Manager, Highways and Network Operations, under delegated authority of the New Zealand Transport Agency.
