Pursuant to section 30R of the Telecommunications Act 2001 ("the Act"), the Commerce Commission ("the Commission") gives public notice of its decision to commence a review under section 30R of the standard terms determination in relation to Telecom’s Unbundled Bitstream Access Service ("UBA STD") dated 12 December 2007.
The UBA STD has been clarified by the Commission on a number of occasions.
The review will assess in which relevant markets that Telecom must supply the Unbundled Bitstream Access Service in response to a request of an Access Seeker.
The Commission notifies that the UBA STD may need to be amended to implement a decision reached about the availability of the Unbundled Bitstream Access Service in relevant markets.
The scope and nature of any amendments required to be made to the UBA STD will also form part of the review.
The closing date for submissions on the questions raised
in the Commission’s letter dated Wednesday 23 June 2010 commencing the review is Friday 23 July 2010.
Under section 30R(1) of the Act, the Commission may, on its own initiative, commence a review, at any time, of all or any of the terms specified in a standard terms determination.
Under section 30R(5)(b), the Commission must give public notice of the commencement of the review.
