Pursuant to section 61(3) of the Government Roading Powers Act 1989 and section 72(1)(ka) of the Transport Act 1962, the New Zealand Transport Agency hereby makes the following bylaw.

1. Title and commencement-This bylaw may be cited
as the New Zealand Transport Agency (Right Turn Ban State Highway 3 To and From Mangati Road) Bylaw 2010/NP1 and will come into force 28 days after the date of publication of this notice in the New Zealand Gazette.
2. Interpretation-In this bylaw, unless the context otherwise requires:
emergency vehicle and enforcement officer have the same meanings as in clause 1.6 of the Land Transport (Road User) Rule 2004.
Intersection means the intersection of State Highway 3 (Devon Road) and Mangati Road at Bell Block in the New Plymouth District.
LTA means the Land Transport Act 1998.
prescribed sign means any sign which is authorised under:
(a) the Traffic Regulations 1976; or
(b) the LTA; or
(c) any rules made pursuant to the LTA, including the Land Transport Rule: Traffic Control Devices 2004; or
(d) any New Zealand Gazette notice issued under clause 4.4 of the Land Transport Rule: Traffic Control Devices 2004.
Vehicle has the same meaning as in section 2(1) of the LTA.
3. Turning restrictions-Subject to the erection of one or more prescribed signs, and subject to clause 4 of this bylaw, the driver of a vehicle must not at the Intersection:
(a) turn to the right from State Highway 3 onto Mangati Road; nor
(b) turn to the right from Mangati Road onto State Highway 3.
4. Exceptions-A person is not in breach of clause 3 of this bylaw if:
(a) they make a right turn at the Intersection in compliance with the directions of an enforcement officer; or
(b) they are an enforcement officer and they make a right turn at the Intersection in the execution of their duty; or
(c) they make a right turn at the Intersection while driving an emergency vehicle being used in an emergency.
5. Offences and penalties-(1) Every person committing any breach of this bylaw is liable upon conviction to a fine not exceeding $500.00.
6. Authority to make bylaw-This bylaw was made by the Group Manager, Highways and Network Operations, under delegated authority of the New Zealand Transport Agency.
