Notice of Making of Electricity Governance (Instantaneous Reserve Dispatch) Amendment Rules 2010 and Notice of Reasons for Decision

1. Pursuant to section 172I of the Electricity Act 1992
("Act"), I notify the amendment of the Electricity Governance Rules 2003 ("Rules") under section 172H of the Act.
2. The empowering provisions for the Electricity Governance Regulations in relation to which the amendments to the Rules are made are sections 172D(1)(1)(a), (b) and (c) of the Act.
3. A brief description of the nature of the amendments is as follows:
(a) Part A is amended to provide definitions to be consistent with the below mentioned amendments;
(b) Schedule C6 of Part C is amended to be consistent with the below mentioned amendments;
(c) Section V of Part G is amended to allow
for compensation to be paid to providers of instantaneous reserve in certain circumstances; and
(d) Schedule G2 of Part G is amended to allow
the System Operator to use additional model parameters for dispatching instantaneous reserve.
4. The amendments are made under urgency in reliance on section 172E(3) of the Act.
5. Pursuant to section 172Z(4) of the Act, the reasons for my decision to amend the Rules are to improve system security by:
(a) improving the dispatch of instantaneous reserve where there is insufficient instantaneous reserve; and
(b) ensuring the providers of instantaneous reserve
are compensated, thus incentivising providers of instantaneous reserve to participate in the market.
6. These Rules come into force on 1 May 2010.
