Notice of Meeting of Creditors
Pursuant to Section 243 of the Companies Act 1993
We, Brian Mayo-Smith and Simon John Francis Peacocke, chartered accountants of BDO Spicers Auckland, were appointed liquidators of the company on 24 June 2009 at 3.30pm.
A meeting of creditors will be held at the offices of BDO Spicers Auckland, Level 8, Rifleman Tower, 120 Albert Street, Auckland City, on Thursday, 16 July 2009 commencing at 2.00pm.
Registration for all creditors will open at 1.30pm with the meeting commencing at 2.00pm.
The business to be transacted at the meeting is whether:
(a) to appoint another liquidator;
(b) that another named liquidator be appointed in place of the appointed liquidators, or to make application to the Court for the appointment of another liquidator; and
(c) to convey the views of creditors to the liquidator.
The following resolutions will be submitted to the meeting:
Resolution A: That there should be a vote on the appointment of the liquidators.
Resolution B: That another named liquidator be appointed in place of the appointed liquidators, or
that an application be made to the Court for the appointment of another liquidator.
Resolution C: That the views of the creditors be conveyed to the liquidators.
Creditors may exercise their right to vote by being present in person, or by appointing a proxy or by postal vote.
