The applicants described below have applied, under section 70 of the Land Transfer Act 1952, for the removal of a right of way. The applicants claim the right of way is redundant by reason of the circumstances set out below.
I intend to remove the right of way on 11 January 2010 if no objections have been received before that date.
Applicants: Chartwell Investments Limited, Bruce Charles Berquist, Audrey Joan Berquist and Te Awamutu Trustees No. 2 Limited, c/o Willis Toomey Robinson, Private Bag 6018, Hawke’s Bay Mail Centre, Napier.
Easement: Right of way over Lot 2 DPS 39890; marked "A" on DPS 41619 comprised in Computer Freehold Register SA35A/343 as appurtenant to Lot 1 DPS 71867 comprised in Computer Freehold Register SA66A/339 created by transfer H674552.2 registered on 15 August 1986.
Circumstances: There is no ability for the dominant owner to physically access the right of way as the common point between Lot 1 DPS 71867 and area "A" on DPS 41619 is the common south-west/north-east boundary point.
Dated at the Christchurch Office of Land Information New Zealand this 27th day of November 2009.
H. E. FRISBY, for Registrar General of Land.
