The applicant described below has applied under section 70 of the Land Transfer Act 1952 for the removal of a water easement.
The applicant claims the water easement is redundant by reason of the circumstances set out below.
I intend to remove the water easement on 27 July 2009, if no objections have been received before that date.

Easement: Water right over Lot 5 on DP 34686 Computer Freehold Register NA5C/648 and over Lot 1 on DP 98038 Computer Freehold Register NA53B/1313; marked “water pipeline easement” coloured pink on DP 34686 as appurtenant to Lot 1, Lots 3–8 and Lot 12 DP 188214 comprised in Computer Freehold Registers NA117D/230, NA117D/232–238 and appurtenant to Lots 1–6 DP 205574 comprised in Computer Freehold Registers NA134A/51–56, created by transfer 451133 registered on 24 March 1949.
Circumstances: The dominant land being Lot 1, Lots 3–8 and Lot 12 DP 188214 and Lots 1–6 DP 205574 has become physically separated from the servient land as a result of subdivision in DP 188214 and DP 205574.
