The applicants claim the water right is redundant by reason of the circumstances set out below.

Easements: Water right over part Lots 1, 2 and 3 DP 396707 comprised in Computer Freehold Registers 385554, 385555 and 385556 respectively, as appurtenant to part Lot 1 DPS 45187 comprised in Computer Freehold Register SA41D/770 and created by transfer 414579, registered on 19 December 1946 at 11.59am.
Circumstances: Part of the dominant land has become physically separated from the servient land as a result of subdivision.
